The quality of service of a member on active duty or active duty for training is affected adversely by conduct that is of a nature to bring discredit on the Military Services or is prejudicial to good order and discipline, regardless of whether the conduct is subject to UCMJ jurisdiction. Characterization may be based on conduct in the civilian community, and the burden is on the respondent to demonstrate that such conduct did not adversely affect the respondents service. The Military considers the reaso ns for separation, including the specific circumstances that form the basis for the separation, on the issue of characterization. As a general matter, regulations require the military to determine characterization upon a pattern of behavior rather than an isolated incident. There are circumstances, however, in which the conduct or performance of duty reflected by a single incident provides the basis for characterization. Types of Discharges Honorable.The Honorable characterization is appropriate when the quality of the members service generally has met the standards of acceptable conduct and performance of duty for military personnel or is otherwise so meritorious that any other characterization would be clearly inappropriate.General (Under Honorable Conditions).If a members service has been honest and faithful, it is appropriate to characterize that service under honorable conditions. Characterization of service as General (under honorable conditions) is warranted when signific ant negative aspects of the members conduct or performance of duty outweigh positive aspects of the members military conduct or performance of duty outweigh positive aspects of the record.Many people believe that separating at the end of the normal term of service guarantees an Honorable Discharge. Isolated incidents and events that are remote in time normally have little value in determining whether administrative separation should be effected.The use of such records ordinarily are limited to those cases involving patterns of conduct manifested over an exte nded period of time. The Administrative Discharge Board The Separation Authority appoints to the Administrative Board at least three experienced commissioned, warrant, or non-commissioned officers. Enlisted personnel appointed to the Board must be in grade E-7 or above and must be senior to the respondent. At least one member of the Board must be serving in the grade of O-4 or higher, and a majority of the board must be commissioned or warrant officers. The senior member is the president of the board. The Separation Authority also may appoint to the Board a nonvoting recorder. A nonvoting legal adviser may be appointed to assist the Board. Rights of the Respondent The respondent may testify in his or her own behalf, subject to the provisions of Article 31(a), UCMJ (Self Incrimination). At any time during the proceedings, the respondent or counsel may submit written or recorded matter for consideration by the Board. The respondent or counsel may call witnesses in his or her behalf. The respondent or counsel may question any witness who appears before the Board. The respondent or counsel may present argument prior to when the Board closes the case for deliberation on findings and recommendations. The Board is required to determine its findings and recommendations in closed sessions. Only voting members of the board may be present. The Board determines the following Whether each allegation in the notice of proposed separation is supported by a preponderance of the evidence.Whether the findings warrant separation with respect to the reason for separation set forth in the Notice, if more than one reason was contained in the Notice, there must be a separate determination for each reason.The Board makes a recommendation of or separation (Not guilty or innocence).If the Board recommends separation, it may recommend that the separation be suspended.If separation or suspended separation is recommended, the Board recommends a characterization of service or descr iption of separation. Basis for Involuntary Separations There are several reasons an individual can processed for involuntary separation. Such conditions may include but are not limited to chronic seasickness or airsickness, enuresis, and personality disorder. Se paration on the basis of personality disorder is authorized only if a diagnosis by a psychiatrist or psychologist, completed in accordance with procedures established by the Military Department concerned, concludes that the disorder is so severe that the members ability to function effectively in the military environment is significantly impaired. Separation for personality disorder is not appropriate when separation is warranted for other reasons. For example, if separation is warranted on the basis of unsatisfactory performance or misconduct, the member usually will not be separated under this section regardless of the existence of a personality disorder. DisabilityA member may be separated for disability under the provisions of 10 U.S.C., Chapter 6l (reference (n)). Disability separations usually result in an Honorable, or Entry Level Separation. Erroneous EnlistmentA member may be separated on the basis of an erroneous enlistment, induction, or extension of enlistment. An enlis tment, induction, or extension of enlistment is erroneous in the following circumstances, if (1) It would not have occurred had the relevant facts been known by the government or had appropriate directives been followed (2) It was not the result of fraudulent conduct on the part of the member and (3) The defect is unchanged in material respects. Erroneous Enlistment. normally receive an Honorable Discharge, unless eligible for an Entry Level Separation (Less than 180 days of military service). Fraudulent Entry Into the Military ServiceA member may be separated on the basis of procurement of a fraudulent enlistment, induction, or period of military service through any deliberate material misrepresentation, omission, or concealment that, if known at the time of enlistment, induction, or entry onto a period of military service might have resulted in rejection. Characterization of service or description of separation is based upon the service record and severity of the fraudulent entry. If the fraud involves concealment of a prior separation in which service was not characterized as Honorable, characterization normally shall be Under Other Than Honorable Conditions. Unsatisfactory wertzuwachsA member may be separated when it is determined that the member is unqualified for further military service by reason of unsatisfactory performance. Separation processing may not be initiated until the member has been counseled formally concerning deficiencies and has been afforded an opportunity to overcome those deficiencies as reflected in appropriate counseling or personnel records. Counseling and rehabilitation requirements are of particular importance with respect to this reason for separation. Because military service is a calling different from any civilian occupation, a member should not be separated when unsatisfactory performance is the sole reason unless there have been efforts at rehabilitation under standards prescribed by the Secretary concerned. The service s hall be characterized as Honorable or General (under honorable conditions). Alcohol Abuse Rehabilitation FailureA member who has been referred to a program of rehabilitation for drug and alcohol abuse may be separated for failure through inability or refusal to participate in, cooperate in, or successfully complete such a program in the following circumstances (1) There is a lack of potential for continued military service or (2) Long-term rehabilitation is determined necessary and the member is transferred to a civilian medical facility for rehabilitation. MisconductA member may be separated for misconduct when it is determined that the member is unqualified for further military service by reason of one or more of the following circumstances Minor Disciplinary Infractions A pattern of misconduct consisting solely of minor disciplinary infractions. If separation of a member in entry-level status is warranted solely by reason of minor disciplinary infractions, the action should be pr ocessed under Entry-Level Performance and Conduct.A Pattern of Misconduct A pattern of misconduct consisting of (a) discreditable involvement with civil or military authorities or (b) conduct prejudicial to good order and discipline.Commission of a Serious Offense Commission of a serious military or civilian offense if in the following circumstances (1) The specific circumstances of the offense warrant separation and (2) A punitive discharge would be authorized for the same or a closely related offense under the Manual for Courts-martial. Civilian Conviction Conviction by civilian authorities or action taken that is tantamount to a finding of guilty, including similar adjudications in juvenile proceedings, when the specific circumstances of the offense warrant separation and the following conditions are present (1) A punitive discharge would be authorized for the same or a closely related offense under the Manual for Courts-martial or (2) The sentence by civilian authorities include s confinement for 6 months or more without regard to suspension or probation. Separation processing may be initiated whether or not a member has filed an appeal of a civilian conviction or has stated an intention to do so. Execution of an approved separation is usually withheld pending outcome of the appeal or until the time for appeal has passed, but the member may be separated before final action on the appeal upon request of the member or upon direction of the Secretary concerned. Characterization of service for misconduct will normally be Under Other Than Honorable Conditions, but characterization as General (under honorable conditions) may be warranted for those with outstanding military records. SecurityWhen retention is clearly inconsistent with the interest of national security, a member may be separated by reason of security and under conditions and procedures established by the Secretary of DefenseinDoD 5200.2-R.Characterization is based on the service record and performa nce of the respondent. Unsatisfactory Participation in the Ready ReserveA member may be separated for unsatisfactory participation in the Ready Reserve under criteria established by the Secretary concerned under DoD Directive 1215.13. These are the most common reasons for involuntary separations from military service. We love to watch rich people behaving badly. And its not like these are the first serials to depict the lives of the rich and famous. They follow in the diamond and blood encrusted footsteps of Dynasty, Dallas, Peyton Place, 90210, Gossip Girl, Billions, etc., Heck, Tom Wolfe made a career (and entire vernacular) out of exposing the underbelly of yuppie narcissism.But with these shows, a part of us thinks, People cant really be this bad, can they? This is for entertainment. Are rich people really this immoral? Well, according to recent research and if you just watch the news (hello Paul Manafort trial), these dramas and ur gage on the wealthy may not be that far off.Dacher Keltner, a psychologist at the University of California, Berkeley and Paul Piff who have spent decades studying wealth, power and privilege through a series of experiments. One looked at cars at a busy four-way intersection and found that it was people in the more expensive cars like Mercedes thatwere four times more likely to ignore the right-of-way laws than those driving cheaper and older cars.When Keltner had a researcher pretend to be a pedestrian crossing, guess which cars actually stopped? Yup, the people in the cheaper cars while only half of the expensive cars did.It told us that theres something about wealth and privilege that makes you feel like youre above the law, that allows you to treat others like they dont exist, Keltnertold the Washington Post.Rich people behaving badlyIn an absolutely shocking finding, Keltner and Piff also found that rich people are literally more likely to STEAL CANDY FROM CHILDREN. In an experiment with 129 subjects, they had them compare their finances to people had mor e or less money. Then they have them a candy jar that was going to be given to children in a neighboring lab but they could take some if they liked. The subjects that were categorically richer than the people they were compared to took more candy for themselves then those were poorer. To researchers who study wealth and power, its dismaying but not surprising because it tracks so closely with our findings. The effect of power is sadly one of the most reliable laws of human behavior, said Keltner.Past studies have also shown that the wealthy are more likely to cheat on their taxes and romantic partners.These studies do make the rich look very culpable but do keep in mind that they are small sets of the wealthy and some of this people could have had immoral and jerk-like tendencies before they acquired wealth.Robert Gore, Ph.D., an associate professor of psychology at Alliant International University, in San Francisco, said when Piff and Keltners study came out that studies linking cl ass and ethics are hard to make conclusive. Not everyone who is coded as relatively high social class drives a luxury car, Gore said to CNN. Luxury car drivers are a subset of the well-to-do, and we all know people who drive cars they cant really afford. He added, This study really shows that people who identify as a higher social class are more likely to admit unethical behavior. Its not clear whether they actually behave worse or just claim to.However, Piff noted that they conducted several experiments and they all had similar results and factors including age, sex, ethnicity, and religious and political affiliations, which can impact ethics and morals, were accounted for.

The 2016 Administrative Law Judge Announcement (https://www.usajobs.gov/GetJob/ViewDetails/433604700) may have closed, but 10-point Veterans may still apply. Pursuant to 5 CFR 332.311, âa 10-point preference eligible is entitled to file an application at any time for an examination for any position for which OPM maintains a register, for which a register is about to be established, or for which a nontemporary appointment was made in the preceding three years. For the purposes of this paragraph OPM shall hold an examination not later than the quarterly period succeeding that in which the application is filed.â In other words, the Administrative Law Judge (ALJ) Program Office, which administers the ALJ exam, continues to do so on a quarterly basis so that 10-point preference eligibles can apply. If you arenât sure how your job posting goals compare to your recruiting goals, consider the following three common hiring scenarios that you can fix with the perfect job posting. You arenât getting enough candidates If you receive one perfect candidate for each job post you submit, then youre the model of efficiency and should be applauded. However, this is rarely the case. According to our research, not getting enough candidate response for a job posting is the most common problem companies face when they begin recruiting. If your current job posting isnât performing, first start with keyword and SEO adjustments to get more eyes on the page. If possible, compare how often your posting showed up in search results to how often it was viewed. Speak the language of the job seeker to make sure potential employees understand whether or not this position would be a good fit for them. Review the job posting to make sure you have explained how candidates will contribute to the company, and describe your company in a way that makes it sound like it is worth contributing to. Youâre getting too many candidates If you arenât getting enough response from your job posting, this particular problem might sound like a blessing. Sure, it may have some of the features that you always envisioned. Maybe you get to help people some of the time, or you have some powerful moments. But the real day-to-day of the job is almost always vastly different.For me, I went to law school to help underserved communities. I always knew the law was a vehicle to help the voiceless. While that is true, there is almost an unbearable amount of stress and drudgery that goes along with helping people in that capacity. I found that I would have to do things I hated 90% of the time in order to get to do the things I love 10% of the time. It wasnât a sustainable model.None of this would be a problem if we lived in a culture that encouraged following our curiosities, taking risks, prioritizing our mental wellbeing, and pursuing fulfillment. One can imagine a world where we are expected to evolve as we age and pivot accordingly. Clearly, thatâs not how we approach work.Rather, weâre raised in a society that drills in us that work is not fun but you do it anyway. We look down on the woo-woo hippy culture of âfollowing your dreamsâ as something for children (and Instagram influencers). In the real world, we have to work to pay bills and support our family. It is just the way it is. Or so weâre told.We also donât want to âwasteâ all the time, energy, and money we put into getting to this level. The idea of starting over is overwhelming. Add in the fact that so many of us are burdened with debt and that we are technically âsuccessfulâ in societyâs eyes, it is no wonder we genuinely feel stuck.But the hard truth is that we are spending 60-70% of our lives doing something we actually hate because we believe thatâs what we have to do. Our health suffers, our families suffer, our friendships suffer and, yet, we push on because the fear of the unknown keeps us in the miserable.I get it. I was there too. I nearly flipped over the table when my husband casually suggested that I should find a job in a different field if I was unhappy. What?! The nerve.But he was right. And I did.It didnât happen quickly. It took me almost a year to admit, mostly to myself, that I wanted to walk away from the one thing that I had worked for my whole life. I worried about what people would say, the opportunities I was giving up, and whether Iâd end up living in a van down by the river. I fretted about it all. Until I realized that working for the next 30-40 years in a profession that was making me miserable in order to have âsecurityâ was insane. So I quit.The most liberating and terrifying thing you can learn is that you have agency. You can leave anytime you want. You choose to stay.
